With the emphasis on could. Now I know that it seems unlikely for Microsoft to go bankrupt in the forseeable future (though there are other scenarios in which support might be dropped), but if that is the reason for stopping activations, there probably won't be a patch either. Companies promise to do that all the time, but if they close shop, no one is willing to invest time and money into developing and distributing such a patch, and there's no one left who feels responsible for it either.
I can't imagine that Microsoft contractually promises indefinite activation, since it's a promise no one could keep. Almost certainly, if the product's support lifetime ends so does Microsoft's obligation to activate or patch it.
